These Terms and Conditions (“Terms”) govern your access to and use of www.southbayballinacademy.com and any related content, features, registrations, purchases, communications, and services made available by South Bay Ballin Academy LLC (“Company,” “we,” “us,” or “our”).

By using this website, you agree to these Terms. If you do not agree, do not use the Site.

You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other person’s use of the Site.

2. Intended Audience

This Site is intended for adults, including parents and guardians interested in our youth basketball programs. If you register a child for services, you represent that you are the child’s parent or legal guardian or otherwise have authority to provide the child’s information and make decisions related to registration.

3. Informational Purposes Only

Content on this Site is provided for general informational purposes only. While we try to keep information accurate and current, we do not guarantee that all content, schedules, pricing, availability, or program descriptions are complete, accurate, or up to date.

Nothing on this Site is medical, legal, or professional advice.

4. Registrations, Purchases, and Program Participation

If you register for a camp, clinic, class, training session, membership, or other service through the Site:

You agree to provide accurate and complete information
You agree to pay all applicable fees and charges
You agree that registrations are subject to availability
You understand that participation in athletic activities may require separate waivers, releases, health information forms, media releases, refund policies, and program-specific rules

Program participation is not governed solely by these Terms. Separate participation agreements, waivers, and policies may also apply and will control where applicable.

5. Payments and Refunds

All payments made through the Site are subject to our then-current pricing and payment terms.

Refunds, credits, transfers, make-ups, and cancellation policies shall be governed by our posted policy in effect at the time of registration or purchase. If no separate written refund policy is posted, then all sales are final unless otherwise required by law.

6. User Accounts

If the Site allows account creation:

You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activity under your account
You must notify us promptly of any unauthorized use of your account

We reserve the right to suspend or terminate accounts at our discretion.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, South Bay Ballin Academy LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, COACHES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT OR SERVICES MADE AVAILABLE THROUGH THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID US THROUGH THE SITE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
(B) ONE HUNDRED DOLLARS ($100).

Nothing in these Terms limits liability where such limitation is prohibited by law.

You agree to defend, indemnify, and hold harmless the Company and its owners, officers, directors, employees, coaches, contractors, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your violation of these Terms
Your violation of any law or third-party right
Information or materials you submit through the Site

14. Termination

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction and venue of those courts.

17. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
